Welcome to CertiHomes. By accessing or using our website at www.certihomes.com and any related subdomains, applications, tools, or services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

CertiHomes is operated by a licensed New Jersey real estate brokerage and mortgage lending organization. These Terms constitute a legally binding agreement between you and CertiHomes.

2. Description of Services

CertiHomes provides the following services through its Platform:

• Real estate property search and listing display
• AI-powered Comparative Market Analysis (CMA) and home valuations
• Mortgage calculators and financial planning tools (WealthWise)
• Real estate market analytics and data (Market Stats)
• Virtual staging and AI image enhancement
• 3D property scanning and floor plan generation (CertiScan)
• Real estate transaction guidance (Journey)
• AI-powered listing assistant and video creation tools
• Agent recruitment and onboarding
• Mortgage point of sale services

3. User Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

Certain features of the Platform may require you to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

5. Real Estate Services Disclaimer

CertiHomes is a licensed real estate brokerage in the State of New Jersey. However:

• Property listings, market data, and CMA reports are provided for informational purposes and should not be the sole basis for real estate decisions
• AI-generated valuations are estimates only and do not constitute a formal appraisal or broker price opinion (BPO)
• Market statistics and analytics are derived from publicly available data and MLS sources and may not reflect the most current market conditions
• Virtual staging images are computer-generated and do not represent the actual condition or furnishing of a property
• All real estate transactions should involve consultation with licensed professionals including real estate agents, attorneys, and inspectors

6. Mortgage and Financial Disclaimer

CertiHomes operates as a licensed Mortgage Loan Originator (MLO) in New Jersey.

• Mortgage calculators, financial tools, and rate information provided on the Platform are for educational and informational purposes only
• Interest rates, payment estimates, and qualification results are not commitments to lend and do not constitute a loan offer
• Actual loan terms, rates, and eligibility depend on credit history, property details, market conditions, and lender requirements
• Financial planning tools (WealthWise) do not constitute financial, investment, or tax advice — consult qualified professionals for personalized guidance
• Equal Housing Lender. NMLS information available upon request

7. Intellectual Property

The Platform and its contents — including but not limited to text, graphics, logos, images, software, AI models, algorithms, data compilations, and user interfaces — are the property of CertiHomes or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works from the Platform
• Reverse engineer, decompile, or disassemble any software or technology
• Use automated tools (scrapers, bots, spiders) to access or collect data
• Remove or alter any copyright, trademark, or proprietary notices
• Use the CertiHomes name, logo, or branding without written permission

8. User Content

By submitting content to the Platform (including property photos, descriptions, reviews, or feedback), you grant CertiHomes a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with the Platform and our services.

You represent that any content you submit:

• Is accurate and not misleading
• Does not violate any third-party rights
• Complies with all applicable laws and regulations
• Does not contain malicious code or harmful material

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Violate any applicable local, state, or federal law or regulation
• Harass, abuse, or harm other users
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the Platform or its infrastructure
• Use the Platform to transmit spam, malware, or unsolicited communications
• Scrape, harvest, or collect data without authorization
• Impersonate any person or entity
• Violate fair housing laws or engage in discriminatory practices

10. Third-Party Services

The Platform integrates with and links to third-party services including but not limited to MLS data providers, mapping services, payment processors, and advertising platforms (Facebook, Google). Your use of these third-party services is governed by their respective terms and privacy policies. CertiHomes is not responsible for third-party content, products, or services.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CERTIHOMES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Errors or inaccuracies in property data, valuations, or market analytics
• Losses from real estate transactions informed by Platform data
• Service interruptions, data loss, or security breaches
• Actions of third-party service providers

Our total liability shall not exceed the amount you paid to CertiHomes in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CertiHomes does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless CertiHomes and its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Platform, violation of these Terms, or violation of any rights of a third party.

14. Fair Housing Statement

CertiHomes is committed to compliance with all federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, sexual orientation, gender identity, or any other protected class. If you believe you have experienced discrimination, please contact us or file a complaint with HUD at hud.gov.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in New Jersey. You consent to the personal jurisdiction of such courts.

16. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
